2.    Definitions

Seller means DIY Auckland Waterproofing (DAW) and its successors and assigns. DAW accepts all the Buyer’s orders for goods or services solely in accordance with the following terms and conditions.

Buyer means the Buyer or any person acting on behalf of and with the authority of the Buyer.

Guarantor means that person (or persons), or entity that agrees to be liable for the debts of the Buyer on a principal debtor basis.

Goods have the same meaning as in s2 of the Sale of Goods Act 1908 and are goods supplied by the Seller to the Buyer (and include any supply of Services as defined below).

Services means all services supplied by the Seller to the Buyer and includes any advice or recommendations (and includes any supply of Goods as defined above).

Price means the cost of the Goods as agreed between the Seller and the Buyer subject to the terms and conditions of trade.

3.     Warranties

DIY Auckland Waterproofing (DAW) warrants that all Goods supplied are carefully inspected and that Goods shall be free from defective materials or workmanship under normal use and are in accordance with specifications whether notified separately in writing or affixed to the Goods.

We do not make any terms, guarantees, warranties, representations or conditions whatsoever regarding the Goods other than provided for pursuant to these Terms.

Subject to this clause, and to the extent permitted by law:

1. Goods are provided to you on “as is” and “as available” basis, and

2. All terms, guarantees, warranties, representations or conditions which are not expressly stated in these Terms are excluded; and

3. We will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Purchase Services or these Terms (including as a result of not being able to use the Purchase Services or the late supply of the Purchase Services), whether at common law, under contract, tort(including negligence), in equity, pursuant to statute or otherwise; and

4. We do not warrant the accuracy, adequacy or completeness of that Goods or that the Goods is suitable for your intended use. You should either seek independent advice or rely on your own judgement.  Any advice, opinion or information is given to assist the use of the Goods on the basis that you will ensure its suitability for the application intended.

4.    Shipping and Return

All sales are final. We do not accept returns, exchanges, or cancellations once an order has been placed. Please review your order carefully before completing your purchase.

We currently offer in-store pickup only for all orders. Please review the following terms before placing your order:

a.        Pickup Location

                                                                              i.        All orders must be picked up at

172A Marua Road, Mount Wellington, Auckland 1051

b.       Order Processing Time

                                                                              i.        Orders are typically reading with 3 working days after purchase.

                                                                            ii.        You will receive an email or text notification once your order is ready for pickup.

c.        Pickup Requirements

                                                                              i.        Orders must be picked up with 14 days of notification.

                                                                            ii.        Orders not picked up within this time may be cancelled.

d.       No Shipping Available

                                                                              i.        We do not ship orders currently. All purchases must be collected at our store location.
